A foreign investor can either buy a property in their personal name or can buy it under a Private Limited or Limited Liability Partnership (LLP).

Rental income - For rental income, it is beneficial to file your taxes in India. TDS 31.2% is deducted then according to your income tax bracket you’ll receive a refund if the applicable tax rate is less than the TDS in your income tax. The highest tax bracket is above rupees 10 lakhs. For rental income above this amount, no TDS refund will be provided. Total income in India will determine the tax liability.
Capital gains tax: Long Term Capital Gain (3 years or more) - 20%, and Short Term Capital Gain (less than 3 years) - 50%. Check for double taxation treaty of India with your county of residence.

Foreign investors can have NRO and NRE accounts. The rental income should be disbursed to either NRO or NRE accounts. NRE is preferable since when the sale of the property takes place you wouldn’t be restricted to only being able to transfer $1 million per fiscal year. NRO has these restrictions. A structure can be incorporated where rental income can be disbursed to the NRO account and the sale of the asset can be disbursed to the NRE account.
