These Terms and Conditions (the "Terms") govern your use of our website located at www.propreturns.com (the "Site") and the online platform services provided by PropReturns Real Estate Technology Pvt. Ltd., it’s directors, agents, employees, officers and those otherwise associated with maintaining the information on this website regarding property, for sale, purchase, rental and/or financing, believe that the information contained on this website is correct and reliable. However, no representation or warranties of any nature are given, intended or implied and you should rely on your own enquiries to determine the accuracy of material available on this website.

The information (qualitative and financial) contained on each individual property for sale, purchase, rental and/or financing has been gathered from the vendor or landlord of the property and professional service providers. We cannot verify or guarantee its accuracy either way. Prospective purchasers, tenants and/or investors must rely on their own enquiries and should verify accuracy of information before proceeding with a purchase, lease or investment.

Any estimated financial information displayed on the Site is based upon third party information which has been obtained by PropReturns and reasonable assumptions of PropReturns. Third Party Services offered by PropReturns

PropReturns may from time to time recommend, feature, certify or refer you to certain third party property service companies ("Featured Property Manager") for the management of the Property you purchase. You are free to use or engage such services at your sole discretion and any decision to do so shall be at your own risk.

Engagement Services

For all of these sourcing, inspections, negotiation and deal-closure services, a brokerage fee of 1.5% + GST on the sale price is payable by the investor against document execution. The investor agrees on engaging with the brokerage services of Reflex Realty LLP, if the investor purchases a property they saw on PropReturns fitting their investment criteria.

For all the brokerage services, a brokerage fee of 2% + GST on the sale price is payable by the seller/owner/developer against document execution. The seller agrees on engaging with the brokerage services of Reflex Realty LLP, if the seller lists his property on PropReturns.com.

PropReturns Real Estate Technology Pvt. Ltd disclaims all liability, responsibility and negligence for direct and indirect loss or damage suffered by any person arising from the use of information presented on this website or material that arises from it.

Other Agreements

Nothing contained in these Terms and Conditions of Use is intended to modify or amend any other written agreement you may have with PropReturns (including without limitation any customer agreement, participation agreement, operating agreement, investment agreement or account agreement) ("Other Agreements") if any, that may currently be in effect. In the event of any inconsistency between these Terms and Conditions of Use and any Other Agreements, the Other Agreements will govern. Some pages within the Website contain supplemental terms and conditions and additional disclosure and disclaimers, which are in addition to these Terms and Conditions of Use. In the event of a conflict, the supplemental terms and conditions and additional disclosures and disclaimers will govern for those sections or pages.

Limitation on Liability

By using the website, you expressly agree that such use is at your sole risk. The website and related services are provided on an "As is", "As available" and "With all faults" basis. Neither propreturns nor any of its respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors or the like (collectively, "Associates") warrant that use of the website or related services will be uninterrupted or error-free. Under no circumstances will propreturns or its associates be liable to you or anyone else for any direct, consequential, incidental, special, exemplary, punitive or other indirect damages, including but not limited to lost profits, trading losses, unauthorized access, systems failure, communications line failure, internet failure or damages that result from use or loss of use of the website, content, inconvenience or delay. This is true even if propreturns has been advised of the possibility of such damages or losses.

Arbitration

Any dispute, controversy or claim arising out of or in relation to this Agreement, including any dispute regarding its existence, validity, effectiveness, interpretation, performance, breach or termination (separately and collectively referred to as “Dispute”), shall be attempted to be resolved by way of conciliation (“Conciliation”).

If the Parties to this Agreement are unable to settle the Dispute by Conciliation within 30 days of the initiation of the Conciliation process, the Dispute shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by PropReturns. The place of arbitration shall be Delhi, India. The arbitration proceedings shall be in the English Language and shall be governed by Arbitration & Conciliation Act, 1996.
